This is a working draft, not legal advice. It was prepared as a starting point for Anabella's Creations and has not been reviewed or approved by the business owner or a lawyer. Every bracketed TBD is a policy decision the owner still needs to make. Cancellation, deposit, and refund terms in particular are placeholders and must be set by the owner before this page goes live.
1. About these terms
These terms apply when you use anabellascreations.com, request a consultation, or place an order with Anabella's Creations, operated by [owner's full/legal name — TBD] as [sole proprietor / LLC — TBD] in Indiana, USA. By using the site or ordering, you agree to these terms. If you don't agree, please don't use the site or place an order.
2. What we do
Anabella's Creations makes custom, handmade items to order: chocolate-covered strawberries, cakepops, custom posters, and personalized themed gift baskets. Each order is designed individually after a consultation.
3. The website is not an offer or a quote
Prices shown on the site are starting points to help you plan. They are not offers, not binding quotes, and not automatically calculated totals. A binding agreement is formed only when Anabella gives you a written quote for your specific order and you accept it in writing (including by email or text). Anabella may decline any request or quote, for example if she doesn't have capacity for your date.
4. Consultations
Consultations are free and carry no obligation to order. We use the details you provide to prepare for the call and, afterward, to prepare your quote (see our Privacy Policy).
5. Orders, deposits, and payment
- An order is confirmed when you accept Anabella's written quote and pay any required deposit.

6. Changes, cancellations, and refunds
Because orders are custom and use perishable ingredients bought specifically for you, the following applies once an order is confirmed. These figures are placeholders — the owner must set the real policy before launch.
- Changes to an order (design, quantity, date) must be requested at least [X days — TBD] before pickup and are subject to availability and price adjustment.
- Your cancellation: deposits are [non-refundable / refundable until X — TBD]. Cancellations within [Y days — TBD] of the pickup date are charged [amount — TBD] because ingredients have been purchased and work has begun.
- Our cancellation: if Anabella must cancel for reasons within her control, you'll receive a full refund of everything you've paid for that order. Her total responsibility in that situation is limited to that refund.
- Quality concerns: contact us within [Z hours — TBD] of pickup with photos so we can make it right. Remedies are at Anabella's discretion and are limited to the amount you paid for the affected item.
7. Pickup
All orders are local pickup only at a time and place arranged with Anabella. We do not currently offer delivery or shipping. If you don't pick up your order during the agreed window, it may be forfeited without refund. Once an order leaves Anabella's hands, keeping it safe — including refrigerating chocolate-covered strawberries and other items that need it, and serving them promptly — is your responsibility.
8. Allergens and food safety
Anabella's food items are made in a kitchen that also handles nuts, dairy, soy, and wheat/gluten, among other ingredients. We cannot guarantee that any item is free from a given allergen or from cross-contact. You must tell Anabella about any allergies or dietary restrictions before you order. It is your responsibility to make sure an item is safe for you and your guests, and to inform your guests of the allergens present. To the fullest extent permitted by law, Anabella's Creations is not liable for allergic reactions where allergen information was not disclosed to her in advance, or where an item was requested despite an allergen warning.

9. Custom designs and intellectual property
- If you provide text, logos, artwork, photos, or other material for a poster or personalized item, you confirm you have the right to use it and to let Anabella use it to make your order. You are responsible for the content of what you supply.
- Designs and artwork Anabella creates remain hers; ordering an item does not transfer ownership of the underlying design.
- Anabella may photograph finished work and use those photos to promote the business (for example, in the gallery or on social media). If you'd prefer she not photograph or post your order, tell her in writing before pickup and she will honor that.
10. Photos and testimonials of your event
We will ask for your written permission before publishing any photo that identifies you, your guests, or your event, or before publishing a testimonial attributed to you.
11. Limitation of liability
To the fullest extent permitted by Indiana law, Anabella's Creations' total liability for any claim arising out of an order or your use of the site is limited to the amount you paid for the order in question. Anabella's Creations is not liable for indirect, incidental, special, or consequential damages, including lost profits or disappointment. Nothing in these terms limits liability that cannot be limited by law.
12. Indemnification
You agree to reimburse Anabella's Creations for losses and reasonable costs arising from your breach of these terms or from material you supplied for a custom item infringing someone else's rights.
13. Governing law and disputes
These terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws rules. Before starting any formal proceeding, you agree to contact us first and try to resolve the matter informally for at least 30 days. Any dispute that isn't resolved that way will be handled by the state or federal courts located in [county — TBD], Indiana, and you and Anabella's Creations consent to that venue.
14. Changes to these terms
We may update these terms as the business changes. The version date at the top will change when we do. The terms in effect when you accept a quote are the ones that apply to that order.
